Forsters acts for tenants in complex case relating to "serviced apartments" and qualification under the enfranchisement legislation

David Smith and Jonathan Dennis v Jafton Properties Ltd [2013]

The decision related to a block in Clerkenwell that was converted a number of years ago into loft style apartments. Two of the flats were let to Mr Smith and two to Mr Dennis. At the date of the claim the apartments were being sub-let to a company that used them as “serviced apartments” .

Forsters has proudly collaborated with Durham Law School to establish the Forsters Prize in Land Law

Durham Law School has announced the introduction of a new examination prize to their existing prizes and scholarships portfolio. The Forsters Prize in Land Law is an annual examination prize established by Forsters LLP. Under the terms of the prize, the top three students based on exam performance will receive financial prizes of £1,200 (1st place), £600 (2nd place) and £200 (3rd place).

Supreme Court's judgment in Daejan Investments Ltd is good news for landlords

The Supreme Court has today handed down its decision in the case of Daejan Investments Ltd v Benson & Others [2013]. The Court has overruled the decisions of the LVT, the Upper Tribunal and the Court of Appeal by granting Daejan Investments Ltd, the landlord, dispensation from the consultation requirements under Section 20 of the LTA 1985.
