James Carpenter

Senior Associate, Property Litigation

James is a Senior Associate in our Property Litigation team.

His practice covers both commercial and residential property disputes, with a particular specialism in enfranchisement and the tenant’s rights of first refusal.

On the commercial side, James advises on lease renewals (opposed and unopposed), rent and service charge disputes, dilapidations, and forfeiture proceedings.

James’s residential practice encompasses a broad range of landlord and tenant matters, including service charge disputes, recovery of arrears, section 20 consolations, breach of covenant issues, disrepair and termination.

His core specialism is leasehold enfranchisement and the tenant’s right of first refusal. James has particular experience dealing with complex collective enfranchisement and house claims. He has acted in several reported cases including in the Upper Tribunal, High Court and Court of Appeal.

James joined Forsters as a trainee in September 2016 and qualified as a solicitor into the property litigation department in 2018.


Reform to leasehold Enfranchisement, The Law Commission’s final report

The Law Commission has published its three final reports on leasehold reform and the future of home ownership. Their recommendations about leasehold enfranchisement and the right to manage are aimed at improving the existing system of leasehold ownership, whilst the third report about commonhold seeks to create a viable alternative to leasehold ownership, with a view to its widespread use in the future.
