London Garden Squares
Forsters is a specialist adviser to the committees and organisations which own or manage private garden squares in London. In 2004 Robert Barham was appointed by the Royal Borough of Kensington and Chelsea to provide external legal advice to the committees which run many private garden squares in the Borough. Since then, he has developed a unique and specialist knowledge in this unusual area of the law and has become a leading legal expert on the subject. During that period he has provided legal advice to the most of the committees that operate garden squares in Kensington and Chelsea but has also been instructed by many committees, trusts and companies in other London Boroughs.
Any of the garden squares in Kensington and Chelsea operate under a unique legal framework established by the Kensington Improvement Act 1851. Others in the Borough operate under the Town Gardens Protection Act 1863 which is a nationwide piece of legislation. Robert Barham was also closely involved with the leading case on the London Squares Preservation Act 1931, Eliterank v the Royal Borough of Kensington & Chelsea [2015].
