Professional negligence

Forsters is one of the leading real estate law firms, servicing both the commercial and residential sectors. We advise all types of clients, from large institutions to individuals, on real estate transactions and we are also well equipped to deal with professional negligence claims that frequently occur in this sector. The firm has specialist litigators in this field who can call upon the expertise of our Commercial Real Estate, Construction, Enfranchisement, Planning and Tax teams to assist us where necessary.

Professional negligence claims are not only commonplace but increasing. We act on claims against lawyers, surveyors, valuers, architects, project managers and engineers.

Drawing upon our combined transactional and property litigation expertise, we are able to advise clients at an early stage as to the true merits of any claim, and the likely costs that will be involved, without the need to rely on a barrister's opinion. We also know which experts to instruct if proceedings are necessary and how such claims can be funded where third party funding is needed.

Forsters has considerable experience of mediation and, because the defendants are nearly always covered by professional indemnity insurance, of dealing with insurers and their solicitors.

The Professional Negligence team is led by three of our Disputes partners; Andrew Head, Natasha Rees and Jonathan Ross. Andrew has particular experience in dealing with valuation claims whilst Jonathan and Natasha specialise in Commercial and Residential property claims respectively. The partners are supported by a talented pool of 18 associates to support with such claims.
