Stress testing and non-contentious structures

We regularly assist with advisory work relating to trusts, succession planning or capacity, in many cases to avoid future disputes. This can involve ‘stress testing’ trusts or wills when they are prepared, upon a review or during a family governance exercise; and assisting the non contentious private client team in establishing or winding up trust structures which involve potentially contentious issues.

Similarly, we also assist on trust, inheritance and capacity related issues regarding pre nuptial and post nuptial agreements, deeds of covenant, or arising on separation and divorce.

Key experience

Advised on cross border estate and domicile

We advised a high net worth client with a complex cross border estate and domicile issues, and existing trust structures, regarding the risk of a post death claim against his estate, including under the Inheritance (Provision for Family and Dependants) Act 1975 and on ways to mitigate that risk.

Nuptial agreement

We assisted the Family and Divorce team in reviewing a nuptial agreement to consider the effect of the agreement in England and Wales, on death or loss of capacity, and considering steps to be taken during the client’s lifetime to mitigate that risk.
