Contentious trusts and estates

When disputes arise in the context of trusts or estates clients need to know that they will be represented by a team of highly responsive lawyers who have extensive knowledge of both trusts and wills, as well as being experienced litigators.

The strength and depth of our private client team and Forsters cross-departmental approach means that clients can be confident that their matter will be looked at from all angles and dealt with as cost-effectively as possible by a lawyer or tailored team of lawyers with the particular expertise relevant to their dispute.

We take an intelligent and creative approach to disputes in the private client world and are often able to achieve a good result for our clients without the need for full recourse to the courts.  Where court proceedings are necessary, our litigation experience means that we are able to handle the process for clients with minimum disruption to their lives.

Forsters regularly deal with all types of probate disputes, including will validity challenges, forgery disputes and bringing/defending challenges under the Inheritance (Provision for Family and Dependants) Act 1975, which allows claimants to apply to the Court for provision out of a deceased’s estate if reasonable provision has not been made for them.

We are also experienced in dealing with a wide range of trust disputes. We regularly advise high-profile trust companies on complex issues relating to succession and tax planning as well as a wide variety of disputes arising in a trust context. Our knowledge of the trust industry means that we are also often instructed by the beneficiaries of trusts to represent their interests.
