Corporate disputes

When disputes arise in a corporate context clients need to know that they have a team of dispute resolution experts on hand with good knowledge and experience of company law who will exert appropriate pressure and proactively seek the best solution, avoiding where possible the uncertainty for the business of long-running litigation.

At Forsters, we act for a range of clients in post-transactional fall-out situations arising on the construction of contracts, misrepresentation, breach of contract and breach of warranty claims.  We also act in disputes where the problem is with insiders – for example claims against directors or by shareholders - or where action is taken from outside (such as governmental action).

Our corporate clients include multi-jurisdictional organisations, investment houses, hedge funds and entrepreneurs. We also deal regularly with insolvency situations, advising directors on their duties and obligations and creditors on their remedies as well as addressing contentious issues relating to restructurings and schemes of arrangements.

We also advise regularly on disputes between shareholders or partners in a business where the key is often to identify whether continuation is possible and then advise clients on the legal options open to them.  Where the relationship can be saved, this will often involve addressing practical issues about working together, including the negotiation of a shareholders’ agreement or other protocol for taking the business forward.
