Prior to lockdown, podcast host Miri Stickland chatted to fellow Knowledge Development Lawyer, Louise Irvine and Senior Associate, Anna Mullins about the impact in practice of the controversial Electronic Communications Code.

“The aim of the new Code was to make connectivity more easily available and to simplify the previous telecoms regime. However, over two years on, we have seen a significant number of Court proceedings being initiated by operators in order to test the new provisions.”

“With Code wayleaves, one of the real sticking points, especially in respect of multi-let buildings, is the ability of the operator to upgrade their apparatus and the current lack of clarity for land owners as to what this means in practice.”

“Where you are redeveloping a site, the more you can engage in advance and work out timescales for when notices need to be served, both to bring the wayleave to an end and to get the equipment removed from site, the better.”
